Where We Lived

For several years my ex-wife (Nancy Oberlander) and I worked out our differences in the state of Tennessee where we lived, our son was born, and the divorce occurred. Nancy repeatedly ran and hid with our son. I was forced to locate them at great expense. Because Nancy's repeated and intentional violations of numerous court orders, in 2005 the Tennessee court, with full knowledge that I lived overseas, gave me full custody and provided Nancy with summer and holiday visitations. By 2006 Nancy moved to Pennsylvania and I sent our son from Europe to Pennsylvania for her summer visitation. Near the end of the summer she filed an emergency petition in Pennsylvania to keep our son stating that Europe was an unsafe environment. Judge White (Pennsylvania) enforced the existing Tennessee order and ordered Nancy to put Aarys on the plane back to Europe. On Sep 1, 2006, Aarys returned to Europe.

In our absence and while both my son and I were living in Europe, Judge White (Pennsylvania) changed custody (more info). Taking jurisdiction based on a summer visitation is in direct violation of both Pennsylvania and US Federal Law. Tennessee continues to contend that Pennsylvania's orders are invalid. Then Judge White (Pennsylvania) issued an arrest warrant for me for failing to appear, and papers containing false information were used to issue an Interpol Red Notice. While these are two states, in the US family law is state law and is similar to two countries.

In Jan 2007 (letter to Nancy's attorney) Nancy disconnected her phone. Later Nancy moved and provided no forwarding address. To this date, she has not provided and address or telephone to us. She states that she has had little contact with our son since September 2006, however this is of her own doing. Until her phone was disconnected, Aarys called her regularly.

Feb: Nancy and I separate.		Feb: I move to Europe for work.
2002
Divorce is final in TN court.

2004
I move back to TN in 2004 so I can take custody of Aarys after PA transfers him back to TN.				Against a court order, Nancy kidnaps Aarys to PA briefly. She provides no contact information to me, or the court. After an expensive investigation, I am able to locate my son through school records. PA court returns Aarys to TN to live with me. Nancy remains in PA.
2005
TN court transfers full custody to me because of Nancy's repeated "flagrant" violations of court orders. TN orders that Aarys move to Cyprus to live with me. Aarys and I move back to Cyprus.		Cyprus is now Aarys' legal home Cyprus now is his "home state". US Law states that for custody issues, other countries are to be treated as other states are. All custody issues must now be resolved in Cyprus courts.
2006
TN contends that PA order is invalid and that its previous 2005 TN order is still in force.				Nancy files in PA for change of custody stating that Europe is unsafe. Dec: Judge transfers custody to her, despite the fact that Aarys is not in PA, and PA has no jurisdiction in this issue. Cyprus does. Aarys has never lived in PA.
2007
				Jan: Nancy's phone is disconnected. We request a new one from her lawyer. No response is ever received.
2008
				Nancy moves out of her house, and provides no new address.
2009
		Oct: During a business trip to Bulgaria I am arrested on charges of kidnapping. The US requests extradition. Dec: Bulgaria refuses my extradition. Dec: Nancy visits Aarys in our home country. Aarys states in front of the court that he wishes to remain where he lives now.		Nancy falsely reports to the FBI that I kidnapped Aarys on Nov 6, 2006 from the US. May: Using Nancy as the witness, and in a secret court hearing, the FBI indicts me of kidnapping. Nancy returns to the US, but the FBI continues to pursue me.
